The disturbance, and what led us to buy lot 2.
I arrive in July of 2009, hired to plant grass on lot 1, a 6 acre lot just de-stumped in the distance. The contractor who hires me, was digging out cattails from the "Wetland" on lot 1. This is when I ask if more lots are for sale. I'm directed to talk with Kevin Walkowski the owner - contractor. Lot-2 in the foreground - dry and de-stumped.
A down payment for $17,000 was placed, Derrick, my son flew home from Hawaii to pick his lot. Attorney Kevin Walkowski, arranged the Bank loan. Walkowski strip's our loam from lot-2 - violating the Banks loan language the day after it was approved by United Bank of Westfield.
Lot-2 was now graded, and pitched to drain, across our lower property. Our good loam stolen. Details to follow.
On 10 /04/2009 Lot-3 was still flat, still at a lower elevation and saturated with water and mud. The driveway was about to be installed. Neighbor tells me this lot is wetland and was reported the the DEP.
The Town's Conservation approved this whole sub division with no wetland studies. By 10/7/2009 the driveway was 3/4 installed. 55 acres of Prime endangered species land is clearcut.
The driveway is raised 4 feet, water starts to flow towards our Lot-2 lot. The Natural Heritage arrives to blame me for having wetlands. 30 to 40 Hawks fly above, not a snake, not a mouse safe. This was forest.
Lot - 3 still all mud as it's elevation is raised 3 to 4 feet.
A pond was excavated and soon over flowed. Our loam was used, more, truckloads more fill was brought up from lower areas on the mountain. Migratory birds started nesting on our lot and they used this pond in the spring of 2010. The pair of birds would be shot.
This map, DEP 2019, shows the filled in wetland, driveway going through the wetland. The old wetland, in green still exists on the State Mapping Site. R Levesque associates is well aware that wetlands are being moved and he draws a new and revised wetland into our property on Lot. 2 trying to make me fully responsible for all wetlands so they can put a new map on line.
